SERVICE AGREEMENT

This Website Development and Hosting Agreement (“Agreement”) is established between America’s Web Club LLC (hereafter referred to as “America’s Web Club”) and the user (“Client”) making a purchase on America’s Web Club’s website, for the provision of web development and hosting services as detailed below.

Project Description: America’s Web Club commits to creating a Content Management System website for the Client within 21 business days of receiving website set up fee. The Content Management System website will include social media links, a logo, a contact form, a bio or service description, a landing page, and an ecommerce merchant or shop.
Service Description: America’s Web Club agrees to provide hosting services for the website specified in the ‘Client Web Development and Hosting Form’, delivered upon order. The services include storage, bandwidth, email accounts, and an SSL certificate as detailed by the third-party hosting provider’s policies.
Uptime: America’s Web Club guarantees that the uptime of the services will be 99% or more, subject to planned maintenance or circumstances beyond America’s Web Club’s control.
Data Backup and Recovery: America’s Web Club agrees to maintain daily backups of the website data and to retain these backups for a period of no less than 14 days. In the event of a catastrophic failure, America’s Web Club will make a good faith effort to restore data from the most recent backup.
Security: America’s Web Club agrees to maintain reasonable security measures to protect the website and data from unauthorized access or attack. These measures include firewalls, encryption, and regular security audits.
Project Timeline: America’s Web Club will endeavor to complete the project within the specified 21-business-day time frame, which includes the time when America’s Web Club is equipped with the details needed to continue. If America’s Web Club is responsible for not delivering within 21 days due to reasons on its side, it will provide a suitable resolution as per industry best practices.
Payment Schedule: The Client agrees to pay America’s Web Club as follows: A one-time set-up fee upon purchasing the package and a monthly hosting fee every month thereafter. Payments are due on the same number date of each month as the initial start date. All major credit and debit cards are accepted.
Intellectual Property: Upon receipt of full payment, America’s Web Club acknowledges that any work produced for the Client under this Agreement shall become the property of the Client, and the Client has the right to modify, sell, and store media they rightfully own.
Account Suspension: If a hosting fee is not paid within a grace period of 30 days from the due date, the Client’s account will be suspended, resulting in the potential loss of data and media associated with the website. This does not include proper termination or manual backups requested by the Client.
Termination Clause: After one year, the Client may cancel the service at any time by contacting their agent. Within the first year, the Client may pay the balance of the yearly fee and cancel with their agent.
Dispute Resolution: All disputes arising out of this agreement shall be resolved through mediation, with jurisdiction in the location of America’s Web Club LLC.
Restricted Content: America’s Web Club will not host content which is federally illegal or unrecognized including but not limited to guns, drugs, firearm sales, pornography of any kind, any hate-based or criminal support sites.

Upon placing their order for service, the Client accepts the terms and conditions of this Agreement.

Terms of Service

By using America’s Web Club LLC’s services, you agree to the following:

Data Collection: We collect personal, business, and specific business details, as well as media such as logos and images. This data is stored on the client’s VPS.
Data Use and Sharing: We do not share or sell data unless required by service providers essential to our operations or by law. When given the option, we always choose not to share our clients’ data.
Cookies and Analytics: We only use necessary cookies and our analytics are set to inform but not stalk our users after they leave our site.
Account Management: Users can request to close their account by email. We delete their information 180 days after closing. Updates can be made through a customer dashboard if their service creates an account or profile.
Age Requirement: Users must be old enough to legally enter into contracts in their jurisdiction of residence.
